他提到在基本法起草最早階段，香港曾有人提出香港「剩餘權力」的概念，他指出當時基本法諮詢委員會的研究報告指，由於香港「回歸」，本質上是中國政府收回香港，對香港恢復行使主權，然後根據中國憲法和《基本法》成立特別行政區，授權行政長官和港府根據《基本法》治理香港，而並非由香港將部分自身權力上繳聯邦政府，然後保留剩餘權力。
