上訴庭指出，入境處有權以行政理由，不准許未經合法結合的異性或同性伴侶申請受養人簽證，但經過合法民事結合或同性婚姻的同性伴侶，可以提供與合法結婚的人一樣的結婚證書，故以行政上做成負擔為由拒絕簽證是不合理。
