聯合國海洋法公約並不承認任何對水域和海床的所謂「歷史權利」，一切海洋權利的申索必須按公約條款判定，但引用葛維寶的觀點，中方也沒有明言南海九段線是什麼，可是今次仲裁庭在裁決中就認定，中方九段線的意思，就是聲稱對九段線範圍內的資源擁有歷史權利。
