控罪指被告於今年四月一日，明知而提供有關傳染病的虛假資料，即訛稱行政長官公布因「沙士」未能受控，宣布香港成為疫埠。事發於愚人節，被告從互聯網下載《明報新聞網》的格式，將內容改頭換面，訛稱特首將香港列為疫埠，市民不能外出，再將假消息上載到自己的網頁。
