戴耀廷指，公民抗命並非一般的違法行為，而是在特定的情况下及符合特定條件下的違法行為。公民抗命者選擇不遵從法院命令，並非蓄意不尊重或挑戰法院的權威。他們是在特定的情况及符合特定的條件下才會不遵法院的命令，目的只是單純地希望透過公民抗命的行動去推動法制能更符公義。
