祁志陳辭時稱，申請人並不爭議是否應興建第三條跑道，但爭議環保署批出環評報告的準則。祈志說，根據《環境影響評估條例》，申請人須按環保署發出的環境影響評估研究概要及技術備忘錄，以制定環評報告予署方批准，但機管局未有按上述要求的方法撰寫報告，例如在航班使用跑道量的評估中，沒有清晰說明擬定的假設，以及有關假設的缺點，環評報告並非按照條例規定而撰寫，故環保署不應批出。
