他（陳祖光）建議當局應修改《警隊條例》，避免警員在執行上司命令時負上刑事責任，「這並不合理，若上司要我發放催淚彈，而我不服從的話，我可能會面對紀律處分。若事情出錯，我便要承擔刑事責任。我們是被訓練作服從指令。」他又指：「如果我正確地執行職責，為何我要就我所作的，承擔刑事負責？這是不公平的。」
