律政司提交立法會司法及法律事務委員會的文件指出,擬制訂的道歉法應適用於所有民事法律程序,包括紀律處分程序和規管法律程序,但《調查委員會條例》(第86章)、《死因裁判官條例》(第504章),以及《淫褻及不雅物品管制條例》(第390章)進行的程序,因屬事實裁斷性質,不涉及責任裁斷,故可獲轄免。

The main objective of enacting the legislation is to clarify the legal consequences – separating apology and liability – so as to encourage the making of apologies, he added. Following two rounds of public consultation, the steering committee recommended the proposed legislation should apply to all civil proceedings, including disciplinary and regulatory proceedings.
Proceedings conducted under the Commissions of Inquiry Ordinance, Coroners Ordinance and Control of Obscene and Indecent Articles Ordinance are exceptions, as they are fact-finding in nature and do not involve determination of liability, the committee explained.
