湯家驊與梁家傑、余若薇等一班大律師，為爭取07/08年雙普選，於03年組成「四十五條關注組」，兩年後決定組黨，成立公民黨，湯家驊是創黨成員之一。

The three former heads of the Hong Kong Bar Association, along with Margaret Ng, joined a group of barristers to establish the Article 23 Concern Group to oppose the government’s proposed anti-subversion legislation in 2002.

After the government backtracked, the group renamed itself the Article 45 Concern Group, calling for universal suffrage. Its members formed the Civic Party in 2006.
