五權分立中的【監察權】，屬於「三權分立」中，由國會立法權所獨立出，融合中國政治史中的「御史大夫」概念，所以具有針砭國政、澄清吏治的崇高位階。並且將「審計權」由立法院移轉至監察院，使政府財政預算的編列審查與決算後的審查，分別由不同的民意機關進行監督，也使行政權在財務編列與使用上，受到更嚴謹的監督。
